Welcome to QubitLink! These Terms of Service ("Terms") constitute a binding legal agreement between you and Studio Next Steps LLC ("we", "us", or "our"), governing your access to and use of our website, API, URL shortening services, analytics tools, and related software (collectively, the "Services").

PLEASE READ THESE TERMS CAREFULLY. BY CLICKING "SIGN UP", ACCESSING, OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT USE THE SERVICES.

1. Account Registration and Security

• Eligibility: You must be at least 13 years old (or the minimum age of digital consent in your country of residence) to use the Services. If you are using the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
• Account Credentials: You are responsible for maintaining the confidentiality of your account credentials (email, password, API keys). You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your credentials.
• One Free Account Policy: To ensure fair usage for all users on our platform, you are strictly limited to one (1) free account per person or legal entity. Creating multiple free accounts to circumvent plan limits (such as link limits, storage quotas, or API rate limits) is a direct violation of these Terms and may result in the immediate termination of all your associated accounts.
• Account Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2. Acceptable Use Policy (AUP)

We prioritize the safety of the internet. We employ an active threat detection system, QubitShield, to enforce this policy. You agree NOT to use the Services to shorten, link to, or distribute URLs that contain or involve any of the following:

2.1 Prohibited Content & Security Threats

• Phishing & Social Engineering: URL destinations that attempt to deceive users into disclosing sensitive information (passwords, financial data) or impersonate legitimate entities.
• Malware & Ransomware: Links that host, distribute, or trigger the download of viruses, worms, trojan horses, ransomware, or other malicious code.
• Technical Abuse:
  • Infinite Redirect Loops: Links that redirect recursively or excessively to degrade service performance.
  • Darkweb/Onion Links: We do not support and strictly prohibit shortening links pointing to the Tor network (.onion) or other dark protocols.
  • Unencrypted HTTP: To ensure user safety, we may block or flag destination URLs that use unencrypted HTTP instead of HTTPS.
• Spam & Unsolicited Communications: Using QubitLink URLs in spam emails, SMS messages (smishing), or unauthorized automated marketing.

2.2 Sensitive Content & Warnings

Certain content categories may be restricted or subjected to mandatory Interstitial Warnings (a safety page shown before the user reaches the destination):

• Adult Content: Pornography, adult dating sites, or explicit material must be flagged as "Sensitive". QubitShield may block such content if it violates local laws or is not properly flagged.
• Gambling & High-Risk Sites: Links to gambling, betting, or high-yield investment programs (HYIPs) may be subject to strict scrutiny and warning interstitials.

No Bypass: You agree NOT to use any technical methods (e.g., cloaking, obfuscation) to bypass QubitShield's security checks or warning pages.

3. Subscription, Billing, and Plans

• Paid Subscriptions: Certain features (e.g., Advanced Analytics, Custom Domains, Higher Rate Limits) are available only with a paid subscription (Pro/Ultra). You agree to pay the fees applicable to your selected plan.
• Payment Processing: We use Stripe as our third-party payment processor. By subscribing, you agree to their service terms and authorize us to charge your payment method on a recurring basis (monthly or annually) until you cancel.
• Plan Limits: Each plan comes with specific usage limits (e.g., number of links, monthly clicks). If you exceed these limits, we reserve the right to throttle your links, display interstitial ads, or require an upgrade.
• Cancellation & Refunds: You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. Payments are non-refundable, including for partial terms, except where required by applicable law.

4. Intellectual Property Rights

• Your Content: You retain all ownership rights to the Original URLs you submit and the custom aliases you create. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to access, store, process, and display your content solely as necessary to provide, secure, and improve the Services (including refining our security and threat detection models).
• Our Property: The Services, including the "QubitLink" name, logo, API, source code, designs, and QubitShield technology, are the exclusive property of Studio Next Steps LLC. You agree not to copy, reverse-engineer, decompile, or create derivative works from our Services.

5. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Specifically, we do NOT warrant that: (a) the Services will be uninterrupted or error-free; (b) the Services will meet your specific requirements; or (c) the AI-generated content (e.g., link titles) will be accurate or suitable for your needs. We are not responsible for the content of the external websites linked via QubitLink.

6. Limitation of Liability

IN NO EVENT SHALL STUDIO NEXT STEPS LLC, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

7. Termination

We reserve the right to suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms (particularly the Acceptable Use Policy). Upon termination, your right to use the Services ceases immediately, and we may delete your data and shortened links.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Services shall be instituted exclusively in the courts of Singapore.

9. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by sending an email, posting a notice on our Service, or updating the "Last Updated" date. Your continued use of the Services after any modification constitutes your acceptance of the new Terms.
